1. Services provided by ND Bed & Breakfast ND Bed & Breakfast will act as an agent to provide the accomodation listed on this website at the rates and conditions listed on this website. Any contract is concluded directly between you and the lessor of the accomodation („Lessor“) 2. Booking Procedure The choice is yours: Either have us put together a suitable offer for you and you book it subsequently or you may want to make use of this online database and book directly afterwards. Once you click on the „book now“ button you will have made a firm booking. You will have concluded an accomodation contract or lodging contract. Lessor and Lessee shall be obliged to adhere to the terms of contract. The basic rule is „It's booked means it's booked“. 3. Particulars and features of accomodation facilities Any particulars listed on this website are merely intended to be descriptions of the accomodation facilities. The presence of any particular features is not warranted. If not stated otherwise, all rates are to be understood excluding value added tax, as most lessors fall below the limit for being obliged to add this tax to their invoices (small enterprise exempt) The agreed lease is to be understood including any utility costs such as electricity, gas, water and the appropriate use of furniture provided. Internet access If the particulars of the accomodation facility state the availability of internet access, only the presence of such amenities is meant. What kind of access it is and whether the Lessor charges any fee for its use you will need to discuss directly with the Lessor. Laundry machine If not agreed otherwise, ther is no washing machine provided. You will find public laundry facilities in the immediate vicinity of many accomodations. One can meet nice people there and have a good cup of coffee or two. 4. Terms of Payment Unless agreed otherwise you will not have to make a downpayment. In this case you will settle the amount in cash or by bank transfer on arrival directly to your host. If a downpayment has been agreed upon you will have to pay this amount directly after booking and the remainder on arrival in cash or by bank transfer. Other methods of payment are not possible. 5. Trip Cancellation Any trip cancellations have to be in writing and shall only be possible free of charge up to 22 days prior to arrival. With cancellations after this date, the following cancellation fees shall apply: 21st up to 8th day before arrival: 30 per cent of the agreed lease. Thereafter and on default of arrival 80 per cent of the agreed lease. 6. Arrival If not agreed otherwise you will be able to make use of the accomodation starting from 6:00 p.m. on the day of arrival. If there is a deposit fee for the key please find this information on our website. Please inform your host in advance about your estimated arrival time. 7. Use of the accomodation facilities Please keep in mind that only the persons or pets stated in the contract may be put up in the rented accomodation facilities. Different persons and/or pets or a higher number thereof can be denied use of the accomodation by the Lessor. (look at point 9) 8. Smoking at the accomodation If not specified otherwise, smoking is not permitted with regard to subsequent users of the accomodation facilities. 9. Changes Please inform us immediately if you intend to put up different or more persons or pets in the accomodation than stated in the Contract of Lease. 10. Departure If not agreed otherwise, you will have to vacate your accomodation by 11:00 a.m. on your day of departure. All facilities are provided by the Lesser / your host in clean condition. Please leave them in the state you have found them in. If any cleaning fees apply, please find them on our website. There you will also find information on whether your host offers cleaning services (for a fee). 11. Deficiencies of the accomodation facilities Please inform us and your Lessor about any deficiencies or shortcomings of your rented accomodation. If there are such deficiencies present you will have your full legal rights against the Lessor. 12. Contract Cancellations ND Bed & Breakfast reserves the right to terminate the contract without prior notice and to demand immediate vacating of the accomodation facilities if you are in breach of your responsibilities concerning appropriate use of the accomodation facilities. Such a case is considered to be present if i. you damage/demolish the leased property ii. you are in breach of the house rules and, after a warning, do not rectify the situation 13. Liability We shall be liable for careful choice and proper procurement of accomodations. Beyond that, liability is regulated by applicable law. 14. Court of Jurisdiction Court of Jurisdiction for any claims of the Lessee against the Lessor shall exclusively be determined by the location of the accomodation facilities. For claims of the Lessor against fully-qualified traders, juristic persons governed by public or private law or persons who do not have place of general jurisdiction in Germany, or who, after conclusion of contract, have moved their permanent residence abroad or whose residence is unknown at the time of filing claims, the domicile of the Lessor is agreed upon as the sole court of jurisdiction. |
